USE OF AIRWALL RX

The Airwall Rx is intended to be used indoors.  Before using the Airwall Rx, carefully read and be certain you understand the User Guide provided by the manufacturer, Zeppelin LLC (“Zeppelin”), the warning labels attached to the Airwall Rx, and this document. When used correctly, the Airwall Rx is designed to create a free-standing inflatable barrier for the purpose of containing contaminants in a single room and safeguarding the spread of contaminants into the adjoining room or space.

ONLY A MEDICAL PROFESSIONAL CAN ADVISE YOU OF THE NEED TO ISOLATE A PERSON INDOORS, IN A SELECTED ROOM.  THE AIRWALL Rx IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. IF YOU (OR THE PERSON PLACED OR INTENDED TO BE PLACED INSIDE THE AIRWALL Rx) HAVE A MEDICAL CONDITION, CONSULT YOUR (OR THE PERSON PLACED OR INTENDED TO BE PLACED INSIDE THE AIRWAL Rx’s) DOCTOR BEFORE USING THE AIRWALL Rx. USE COMMON SENSE

Use of the Airwall Rx should not replace your good judgment or common sense. Please read and comply with all safety notices, warnings, and instructions that accompany the Airwall Rx.

LIMITED WARRANTY

Zeppelin warrants solely to the Original Purchaser (which means a business entity, agency, foundation, governmental entity, association, or individual that purchases the Airwall Rx from Zeppelin or its authorized distributors) that each Airwall Rx will be free from defects in materials and workmanship, when correctly used and maintained, for 12 months from the date of purchase. This limited warranty is not transferable. Zeppelin’s entire liability and Original Purchaser’s sole and exclusive remedy for any breach of this limited warranty will be, at Zeppelin’s option, (a) to replace the defective Airwall Rx, or (b) refund to the Original Purchaser the amount the Original Purchaser actually paid to Zeppelin.

This limited warranty does not cover: a) any damage caused as a result of improper use or operation, abuse, negligence, neglect, modification or alteration of the product; b) repairs made by anyone other than Zeppelin; c) any damage or contamination due to cigarette, pipe, cigar or other smoke or any other smoking device including, but not limited to eCigarettes and vape pens; d) any damage or contamination due to insect or rodent infestation; e) any damage or contamination due to mold, spores, fungus, or microorganisms that may or do cause illness, disease or death, and e)  acts of God or other acts not within the control of Zeppelin. This limited warranty does not cover damage caused by regular wear and tear.

Warranty is void on a product sold, resold, or transferred to anyone other than the Original Purchaser.

DISCLAIMERS AND LIMITATION OF LIABILITY

THE AIRWALL Rx IS NOT DESIGNED OR INTENDED TO BE USED AS A MEDICAL DEVICE.  THE AIRWALL Rx IS NEITHER REGULATED NOR APPROVED BY THE U.S. FOOD AND DRUG ADMINISTRATION. IT IS NOT DESIGNED OR INTENDED TO DETECT OR PREVENT ANY MEDICAL CONDITION, AND IT IS NOT DESIGNED OR INTENDED FOR USE IN THE DIAGNOSIS OF DISEASE OR OTHER CONDITIONS, OR IN THE CURE, MITIGATION, TREATMENT, OR PREVENTION OF DISEASE OR CONDITION.  THE AIRWALL Rx IS INTENDED TO BE USED TO HELP YOU OBSERVE AND MONITOR THE WELLBEING OF AN INDIVIDUAL IN YOUR HOME.  IT IS NOT A SUBSTITUTE FOR MEDICAL CARE OR ADULT SUPERVISION. YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT YOUR USE OF THE AIRWALL Rx AND OUR RELATED PRODUCTS IS ENTIRELY AT YOUR OWN RISK.

THIS PRODUCT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. NO REPRESENTATIONS OR WARRANTIES OF ANY KIND ARE MADE, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS PRODUCT OR THE USE OF, CONTENT OF, MATERIALS CONTAINED IN THIS PRODUCT. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS PRODUCT IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, ZEPPELIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ZEPPELIN DOES NOT WARRANT THAT THE PRODUCT AND/OR ANY OR ALL OF ITS COMPONENT PARTS ARE FREE OF DEFECTS OR OF HARMFUL COMPONENTS. ZEPPELIN, ITS OFFICERS, EMPLOYEES, INTERNS, AGENTS, CONTRACTORS, SUPPLIERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS PRODUCT, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

EXCLUSIONS FROM LIABILITY

IN NO EVENT SHALL ZEPPELIN, ITS OFFICERS, EMPLOYEES, INTERNS, AGENTS, CONTRACTORS, SUPPLIERS AND LICENSORS, BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR ANY LOST PROFITS RESULTING FROM THE USE OR INABILITY TO USE, OR THE INSTALLATION OF THE ZEPPELIN PRODUCT, WHETHER RESULTING FROM BREACH OF WARRANTY, BREACH OF CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL ZEPPELIN BE LIABLE FOR DAMAGES OF ANY KIND IN EXCESS OF THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.

USE OF NON-ZEPPELIN MODIFICATION, ALTERATION OR PRODUCTS

Zeppelin, its officers, employees, interns, agents, contractors, suppliers and licensors, will not be liable for any damage caused in whole or in part by any part, accessory, materials or products that are not manufactured by Zeppelin.  

The Airwall Rx must be used in compliance with all instructions and warnings supplied to the Original Purchaser.  Zeppelin, its officers, employees, interns, agents, contractors, suppliers and licensors, will not be liable for any damage caused in whole or in part by any alteration or modification made to the Airwall Rx by any person, including the Original Purchaser.

COMPLIANCE WITH LAWS

Original Purchaser acknowledges that Zeppelin has no control over the use of the Airwall Rx by Original Purchaser or any entity or individual to which Original Purchaser may rent, lease, sell or otherwise transfer the Airwall Rx (such entities or individuals are referred to as “Customers”). Original Purchaser must, at its sole expense, comply with all municipal county, state and federal laws, ordinances and regulations, while it is in the possession of and use by the Original Purchaser and its Customers.

Original Purchaser is prohibited from selling or exporting the Airwall Rx to any third party in any country other than the United States, unless given written permission to do so by Zeppelin and unless Original Purchaser first obtains all appropriate U.S. and foreign government licenses and permissions.

These chemicals are known to the State of California to cause cancer and birth defects or other reproductive harm.
